Welcome to TERAVARNA Marketplace. These Terms & Conditions govern the access, use, purchase, sale, and participation in the TERAVARNA Marketplace platform by artists, collectors, buyers, sellers, and visitors.
By accessing or using TERAVARNA Marketplace, users agree to comply with and be legally bound by these Terms & Conditions, along with all related marketplace policies, including Shipping & Return Policy and Privacy Policy.
Marketplace Overview
TERAVARNA Marketplace operates as an online marketplace platform that facilitates connections between artists, collectors, and buyers for the display, promotion, purchase, and sale of artworks and related creative products. TERAVARNA Marketplace functions solely as an intermediary facilitator and does not assume ownership, custody, or title of artworks listed on the platform unless explicitly stated otherwise in writing.
Eligibility
By using TERAVARNA Marketplace, users represent and warrant that they are at least 18 years of age or are accessing the platform under lawful parental or guardian supervision; possess the legal authority to enter into binding agreements; will provide accurate and truthful account and transaction information; and will comply with all applicable laws and regulations. TERAVARNA reserves the right to suspend, restrict, or terminate any account or marketplace access found to violate marketplace policies, engage in fraudulent activities, misuse, or violate applicable legal requirements.
Artist Responsibilities
Artists listing artworks on TERAVARNA Marketplace agree and represent that they are the rightful owner or authorized creator of the submitted artworks and that all uploaded content, including images, descriptions, and materials, does not infringe upon any copyright, trademark, intellectual property, or proprietary rights of third parties. Artists further agree that artwork descriptions, dimensions, pricing, specifications, and visual representations are accurate and truthful, and that artworks will be professionally packaged to ensure safe transit and delivery. Where required, artists shall cooperate in shipping coordination, customs documentation, and dispute-resolution processes. Artists remain fully responsible for the originality, legality, authenticity, and ownership of the artworks listed on the marketplace.
Buyer & Collector Responsibilities
Buyers and collectors using TERAVARNA Marketplace agree to provide accurate billing, shipping, and payment information and to carefully review artwork descriptions, dimensions, materials, pricing, and applicable marketplace policies before completing a purchase. Buyers further agree to pay all applicable charges, including shipping fees, customs duties, VAT, taxes, and import levies where applicable, and to cooperate in return or dispute investigations by providing supporting evidence when reasonably requested. Buyers acknowledge and accept that artworks may appear slightly different in color, texture, or appearance due to screen settings, lighting conditions, photography variations, or digital display differences.
Pricing & Payments
All prices displayed on TERAVARNA Marketplace are subject to change without prior notice and may vary based on artwork availability, artist updates, shipping considerations, or marketplace adjustments. All payments must be completed through approved and secure payment gateways authorized by TERAVARNA Marketplace, and TERAVARNA does not directly store complete payment credentials, banking details, or sensitive financial information on its servers. TERAVARNA further reserves the right to cancel, refuse, suspend, or investigate any transaction suspected of fraud, unauthorized activity, misuse, payment irregularities, or violations of marketplace policies and applicable laws.
Shipping Policy
TERAVARNA Marketplace supports both domestic and international shipping.
Domestic Shipping
Domestic shipping applies when both the artist and buyer are located within the same country. Where applicable, TERAVARNA may assist in coordinating logistics and shipping arrangements.
If both the artist and collector reside within the United States, TERAVARNA may cover shipping expenses exceeding up to USD $200 for artworks priced above USD $1000, where applicable and approved.
International Shipping
International shipping applies when the artist and buyer are located in different countries. International shipping, transportation fees, customs duties, VAT, taxes, and destination-specific import charges shall be borne by the buyer or collector unless otherwise stated.
Shipping costs may vary depending on artwork dimensions, packaging requirements, destination country, and logistics provider rates.
Failure to pay applicable customs duties or taxes may result in shipment delays, confiscation, or return of artworks, for which TERAVARNA shall not be held liable.
Packaging & Transit Safety
Artists are responsible for securely and professionally packaging artworks to ensure safe handling and transit during shipping, and shipping insurance may be included where applicable. TERAVARNA Marketplace may assist in facilitating communication and coordination between buyers, artists, and logistics providers in the event of shipping damage, delays, or transit-related issues; however, TERAVARNA does not guarantee carrier performance, delivery timelines, or uninterrupted logistics services. Any shipping timelines displayed on the marketplace are estimates only and may vary due to customs procedures, carrier delays, weather conditions, international regulations, or other circumstances beyond TERAVARNA’s reasonable control.
Return & Refund Policy
Returns are accepted only under the following conditions:
- The artwork arrives physically damaged, or
- The artwork is materially different from the description or displayed marketplace images
Return requests must be initiated within 14 days of delivery.
Returns will not be accepted for:
- Change of mind
- Personal preference
- Impulsive purchases
To submit a return request, buyers must provide sufficient supporting documentation, including photographs of the artwork, packaging images, unboxing photos where possible, and video evidence demonstrating the damage or defect.
Return claims lacking adequate evidence may be denied.
If a return claim is verified and approved, TERAVARNA will review the matter to facilitate a fair resolution and minimize unnecessary return transportation burdens on the buyer where reasonably possible.
If a return request is determined to be unsubstantiated or ineligible, return shipping costs shall be the responsibility of the buyer or collector.
Approved returns must be securely repackaged and shipped within the approved return period. Improper packaging resulting in additional damage may void refund or return eligibility.
Intellectual Property
All content available on TERAVARNA Marketplace, including logos, branding elements, graphics, marketplace design, text, images, website layouts, and platform materials, is the property of TERAVARNA or the respective content owners and is protected under applicable copyright, trademark, and intellectual property laws. Users may not copy, reproduce, distribute, modify, republish, or commercially exploit any marketplace content without prior written permission from the rightful owner. Artists retain ownership and intellectual property rights to their submitted artworks unless otherwise agreed in writing through a separate contractual arrangement.
Limitation of Liability
TERAVARNA Marketplace functions as a facilitator between artists, buyers, collectors, shipping providers, and payment processors.
To the fullest extent permitted by law, TERAVARNA shall not be liable for:
- Shipping delays or carrier-related issues
- Customs delays or import restrictions
- Damage caused by improper handling after delivery
- Indirect, incidental, or consequential damages
- Losses arising from third-party services or external platforms
TERAVARNA does not guarantee uninterrupted access to the marketplace or error-free operation of the platform.
Third-Party Services
TERAVARNA Marketplace may contain links to third-party websites, payment gateways, logistics providers, artist websites, social media platforms, or other external services for convenience and marketplace functionality. TERAVARNA does not control and is not responsible for the content, services, privacy practices, security measures, or operational policies of any third-party platforms or providers. Users access and interact with such third-party services at their own discretion and risk and are encouraged to review the respective terms and privacy policies of those external platforms independently.
Privacy
Use of the TERAVARNA Marketplace is also governed by the Marketplace Privacy Policy, which explains how user information is collected, stored, processed, and protected.
By using the marketplace, users consent to the collection and use of information as outlined in the Privacy Policy.
Suspension & Termination
TERAVARNA reserves the right to suspend, restrict, or terminate user access to the marketplace at its sole discretion if users:
- Violate these Terms & Conditions
- Engage in fraudulent or abusive conduct
- Misuse of marketplace services
- Violate intellectual property rights or applicable laws
Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the applicable laws governing TERAVARNA Marketplace operations, without regard to conflict-of-law principles. Any disputes, claims, or legal matters arising out of or relating to the use of TERAVARNA Marketplace, its services, transactions, or policies shall be subject to the jurisdiction and legal framework determined by TERAVARNA in accordance with applicable governing laws.
Modifications to Terms
TERAVARNA Marketplace reserves the right to modify, revise, or update these Terms & Conditions at any time without prior notice.
Updated versions will be posted on the marketplace website with the revised effective date. Continued use of the marketplace after such updates constitutes acceptance of the revised Terms & Conditions.
